The short answer
Do not assume every Sarasota condominium follows the same window-tinting rule. Start with the declaration, bylaws, architectural standards, and current association procedures. Determine how the documents classify the window, whether written approval is required, and what exterior-appearance information must accompany the proposal.
Begin with the governing documents
Florida condominium law assigns common-element maintenance responsibility to the association except where a declaration assigns certain limited common-element maintenance to unit owners. It also says material alterations to common elements or association property must follow the procedure in the declaration, with statutory voting rules applying when the declaration does not specify one.[1]
That does not decide a particular window-tinting request by itself. The declaration and other governing documents matter, and window responsibility can vary. Ask the association or property manager for the current written rule and review process rather than relying on a neighbor's project or an old verbal answer.
Five questions to answer before selecting tint
How is the window classified?
Find the sections addressing windows, glass, unit boundaries, common elements, limited common elements, and maintenance responsibility.
Is written approval required?
Ask for the current architectural request form, submission route, meeting schedule, and the information needed for a complete review.
What can be seen outside?
Look for rules covering exterior color, reflectivity, darkness, consistency, and unified building appearance.
What glass is installed?
Record pane markings, manufacturer information, insulated or laminated construction, coatings, existing tint, and visible damage.
Build a review packet around facts
A complete proposal can include the exact windows, photographs from inside and outside, dimensions, existing glass information, product documentation, visible transmittance, reflectivity or exterior appearance, and a sample when requested. Keep approval of appearance separate from technical glass compatibility; both questions need clear answers.
The Florida Department of Business and Professional Regulation says its condominium division reviews governing documents for statutory compliance and provides education about the rights and responsibilities of associations, board members, and unit owners.[2] For a dispute or legal interpretation, use official resources or qualified counsel rather than treating this project checklist as legal advice.
Do not mix ordinary tint with hurricane protection
Section 718.113 includes separate provisions for condominium hurricane-protection specifications and allows factors such as color, style, and unified exterior appearance in that specific context.[1] Those provisions should not be generalized into a claim that ordinary solar or privacy tint is approved hurricane protection.
